How is surrogacy different from IVF?
Surrogacy involves another person carrying a pregnancy for intended parents. IVF describes a fertility treatment technique. These are different concepts: access to IVF does not itself establish eligibility for a surrogacy arrangement. This guide provides questions to investigate, not personalised medical or legal advice.
What do mainland China rules say?
China’s Measures for the Administration of Human Assisted Reproductive Technology prohibit medical institutions and medical personnel from implementing surrogacy techniques in any form. IVF consultation for travel to mainland China must not be presented as a surrogacy arrangement or as a route around these rules.
Is surrogacy abroad always legal?
There is no single overseas rule. The destination and intended parents’ home jurisdiction may have different requirements for eligibility, agreements, legal parenthood and returning home. Seek independent qualified legal advice in the relevant jurisdictions before signing, paying or travelling. Another family’s experience is not a determination of your eligibility.
What should a cost estimate include?
Request itemised written estimates for applicable medical, legal, coordination, insurance, travel, accommodation and documentation expenses. Identify exclusions, payees, payment milestones, cancellation terms and potential additional costs. A starting price is not a personalised total. This guide does not advertise surrogacy packages or donor prices.
What should be checked before an agreement?
- Each party’s identity, registration and responsibilities.
- The healthcare provider’s relevant authorisation.
- Independent legal representation and voluntary informed consent.
- Insurance, medical risks, dispute processes and exit terms.
- Handling and disclosure of identity and medical records.
- Assessment of parenthood, birth documents, nationality and travel documents.
Can parenthood or travel documents be guaranteed?
Do not rely on an agency’s verbal assurances. Legal parenthood, nationality and travel documentation can involve separate laws and official decisions. UK government guidance recommends independent specialist advice both in the UK and the destination before arrangements; this guidance is UK-specific, not a universal eligibility rule.
